This Privacy and Cookie Policy ("Policy") describes the personal data collected or generated (processed) when you use EVERKI's website everki.com (the "Site"): what we collect, how it is used, shared and protected, the choices you have, and how to contact us.

EVERKI USA, Inc. and its affiliate(s) are referred to as "EVERKI" or "we".

What Personal Data We Collect and When

We ask you for certain personal data to provide you with products or services, for example when you make purchases, contact our customer service, request to receive our newsletter, create an account, or interact with our Site. This personal data includes:

  • Contact details including name, email, telephone number and shipping and billing address
  • Login and account information, including screen name, password and unique user ID
  • Personal details including gender, date of birth, product serial number and purchase history
  • Payment or credit card information, which is processed by our payment service providers; EVERKI does not store full card numbers on its own systems
  • Images, photos and videos you choose to submit
  • Personal preferences including your wish list, marketing and cookie preferences

When you interact with our Site, certain data is collected automatically by the technology platforms providing the experience. This data includes:

  • Cookies, IP address, referrer headers, data identifying your web browser, device and operating system, approximate location derived from your IP address, pages viewed, links clicked, and web beacons, pixels and tags
  • Behavioral interaction data such as mouse movements, clicks, scrolling and keystroke patterns on our Site (with entered text masked), collected through the analytics services described below

Analytics, Advertising and Session Replay Technologies

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products and services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products and services and online activity. Additionally, we use this information for site optimization, fraud and security purposes, and advertising. Microsoft Clarity is configured to mask text you type into forms and other sensitive content before it reaches Microsoft. We also use Google Analytics, Google Ads, Google Tag Manager, Meta (Facebook) tools, Microsoft (Bing) Advertising and Klaviyo as described in the Cookies section below, where you will also find the tools available to control these technologies.

Tools to Manage What We Collect

In many cases, your web browser or mobile device platform provides additional tools to control when your device collects or shares particular categories of information, such as cookie usage or location sharing. We encourage you to familiarize yourself with and use the tools available on your devices.

Why and How We Use (Process) Your Personal Data

To Provide the Features of the Site You Request

When you use our Site, we use your data to provide the product or service you have selected. For example, if you make a purchase on everki.com, we use the contact information you give us to communicate with you about the purchase. If you reach out to our customer service, we use information about you, such as delivery or payment information, or the product you have purchased, to help you resolve a problem or question.

To Let You Know About Our Products, Services, and for Other Promotional Purposes

If you are an existing customer of EVERKI (for example, if you have placed an order with us), we may use the email address provided to send you marketing communications about similar EVERKI products, unless you have opted out. In other cases, we ask for your consent to send you marketing information. We may use the information you provide to personalize communications about products that may interest you. Where legally required, we seek your consent before sending marketing communications.

To modify your email subscriptions or opt out of receiving EVERKI communications, adjust your preferences in the "My User Profile" section of our Site, use the unsubscribe link in any marketing email, or contact us at privacy(at)everki.com.

To Operate and Improve Our Business, Products and Services

We may use the data you provide to operate our business. For example, when you make a purchase, we may use that information for accounting, shipping, auditing and other internal functions. We may also use data about how you use our products and services to enhance your user experience, diagnose technical and service problems, and administer our Site.

To Protect Our or Others' Rights, Property or Safety

We may use data about how you use our Site to prevent or detect fraud, abuse, illegal uses and violations of our Terms of Use, and to comply with court orders, governmental requests or applicable law.

For General Research and Analysis Purposes

We use data about how visitors use our Site to understand customer behavior and preferences. For example, we may use information about how visitors search for and find products to better organize and present our product offerings.

Sharing of Your Personal Data

EVERKI's Sharing

EVERKI shares your personal data with:

  • EVERKI affiliates, for the purposes and under the conditions outlined above
  • Third party service providers processing personal data on EVERKI's behalf, for example to process credit cards and payments, ship and deliver orders, host and manage our data, distribute emails, perform research and analysis, manage brand and product promotions, and administer certain Site services and features. These providers are contractually restricted from using your personal data for their own purposes.
  • Advertising and analytics partners as described under "Sale and Sharing of Personal Information" below
  • Other third parties to the extent necessary to: (i) comply with a government request, court order or applicable law; (ii) prevent illegal uses of our Site or violations of our Site's Terms of Use and our policies; (iii) defend ourselves against third party claims; and (iv) assist in fraud prevention or investigation (e.g., counterfeiting)

We may also transfer personal data we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

Sale and Sharing of Personal Information

EVERKI does not sell your personal information in exchange for money. Like most e-commerce businesses, however, we use advertising cookies and pixels from partners such as Google, Meta (Facebook) and Microsoft that collect identifiers and internet activity from our Site to deliver advertising tailored to your interests on other websites and apps. Under the California Consumer Privacy Act, this kind of disclosure may be considered "sharing" of personal information for cross-context behavioral advertising.

You can opt out of this sharing at any time by enabling the Global Privacy Control in your browser, which we honor as a valid opt-out signal, by using the industry opt-out tools listed under "Your Cookie Choices" below, or by contacting us at privacy(at)everki.com. Your Sharing

When you use certain social features on our Site, you can create a public profile that may include information such as your screen name, profile picture and hometown. You can also share content with your friends or the public, including reviews.

Protection and Management of Your Personal Data

Encryption and Security

We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the safety of your personal data. Your personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to those systems. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal data, we will notify you and the relevant authorities where required by applicable law.

International Data Transfers

The personal data we collect or generate (process) in the context of our Site will be stored in the USA. Some of the data recipients with whom EVERKI shares your personal data may be located in countries other than the country in which your personal data was originally collected. The laws in those countries may not provide the same level of data protection. Nevertheless, when we transfer your personal data to recipients in other countries, including the USA, we protect that personal data as described in this Policy and in compliance with applicable law.

If you are located in the European Economic Area ("EEA"), the United Kingdom or Switzerland, we take measures to comply with applicable legal requirements, including the use of appropriate safeguards, to ensure adequate protection for transfers of personal data to recipients in countries outside of the EEA, the UK or Switzerland.

Retention of Your Data

We retain your personal data for as long as necessary to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. The criteria we use to determine retention periods include: the duration of our relationship with you (for example, while you hold an account), our legal obligations (for example, tax and accounting record-keeping), and the applicable statutes of limitations for legal claims. When personal data is no longer needed, we delete or de-identify it.

Your Rights Related to Your Personal Data

Depending on where you live, you have the right to request: (i) access to your personal data; (ii) correction of your personal data if it is incomplete or inaccurate; or (iii) deletion of your personal data. You also have the right to object to the processing of your personal data, including opting out of its use for direct marketing purposes. Where we have obtained your consent for processing, you may withdraw it at any time. To exercise any of these rights, contact us using the details in the "Questions and Feedback" section below. We will not discriminate against you for exercising your privacy rights.

Your California Privacy Rights

This section applies to California residents and supplements the rest of this Policy. It serves as our Notice at Collection under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA").

In the last 12 months we have collected the following categories of personal information. We do not sell personal information for money. The "Shared for advertising" column shows the categories disclosed to advertising partners for cross-context behavioral advertising.

We collect these categories for the business and commercial purposes described in "Why and How We Use (Process) Your Personal Data" above, and we retain them as described in "Retention of Your Data." We do not collect or process sensitive personal information for the purpose of inferring characteristics about you, and we do not knowingly collect or share the personal information of consumers under 16 years of age.

Your Rights

  • Right to know and access: request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties to whom it was disclosed.
  • Right to delete: request deletion of the personal information we have collected from you, subject to legal exceptions.
  • Right to correct: request correction of inaccurate personal information.
  • Right to opt out of sale or sharing: direct us not to sell or share your personal information for cross-context behavioral advertising.
  • Right to limit use of sensitive personal information: we do not use sensitive personal information beyond the purposes permitted by the CCPA, so no separate limitation is needed.
  • Right to non-discrimination: we will not deny you goods or services, charge you different prices, or provide a different level of quality because you exercised your privacy rights.

How to Exercise Your Rights

Submit a request by emailing privacy(at)everki.com, calling +1 949 502 6688, or using our contact form. To opt out of sharing for cross-context behavioral advertising, turn on the Global Privacy Control (GPC) in your browser; we treat GPC signals as a valid request to opt out of sharing for that browser. You can also use the industry opt-out tools listed under "Your Cookie Choices" below.

We will verify your request using information associated with your account or previous interactions with us, and respond within the timeframes required by law (generally 45 days). You may designate an authorized agent to make a request on your behalf; we will require proof of the agent's authorization and may still need to verify your identity directly.

California's "Shine the Light" law (Civil Code § 1798.83) permits California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

Do Not Track and Global Privacy Control

Because there is no common industry standard for legacy browser "Do Not Track" signals, our Site does not respond to them. We do, however, honor the Global Privacy Control signal as an opt-out of sale/sharing as described above.

Children's Privacy

Our Site is intended for a general audience and is not directed to children. We do not knowingly collect personal information from children under 13 years of age. If you believe a child has provided us with personal information, contact us at privacy(at)everki.com and we will delete it.

Cookie Policy

We use cookies and similar technologies to make the Site work, to understand how it is used, and to deliver relevant marketing. Below you will find the cookies set by everki.com and by third-party services, grouped by category, along with the tools you can use to control them. Visitors browsing our European store views are shown a cookie consent banner where these categories can be managed directly; on this store view, use the choices described under "Your Cookie Choices" below.

What Are Cookies?

A cookie is a small text file that a website saves on your computer or mobile device when you visit. It enables the website to remember your actions and preferences (such as login, language, country and display preferences) over a period of time, so you don't have to keep re-entering them whenever you come back to the Site or browse from one page to another. Third parties may also collect information via the Site through cookies, plug-ins and widgets; that data is collected directly from your browser and is subject to those third parties' own privacy policies.

How Do We Use Cookies?

There are three categories of cookies used on our Site:

  • Marketing: used by us and our advertising partners (Google, Meta, Microsoft, Klaviyo) to deliver and measure advertising relevant to your interests, on our Site and elsewhere. Refusing these cookies results in less relevant advertising; these are the cookies covered by the California opt-out of "sharing" described above.
